Terms of Service

1. Acceptance

By ticking “I Agree,” signing any Casaztech document, or purchasing a Casaztech service, you (“Client”) accept these Terms of Service (“TOS”), which govern all access to pm.casaztech.com and every current or future offering of Casaztech Property Management (“Casaztech”).

2. Definitions

Term Meaning
PMaaS Subscription Property-Management-as-a-Service program.
Owner Wallet Client-funded digital wallet used for authorized expenses.
Background-Check Report Same-day screening covering Mexican databases only.
Marketing Lead Tools Informational content (e.g., reports, checklists, webinars) offered free or paid to attract prospects; not legal, investment, or tax advice.
Service Agreement Any separately executed Subscription, Tenant Placement, or Statement-of-Work (SOW) document.

3. Scope of Services

3.1 PMaaS
Services and tiers are detailed in the relevant Subscription Agreement, which prevails over these TOS in case of conflict. Only specified tiers include an Owner Wallet.

3.2 Tenant Placement
Fees, duties, and any exclusivity period are governed solely by the individually executed Tenant Placement Agreement.

3.3 Background-Check Reports

  • Delivered electronically on the same business day.

  • Casaztech is not liable for Client’s leasing or investment decisions based on a report.

  • Casaztech obtains the data subject’s written consent; Client must supply accurate subject data.

3.4 Marketing Lead Tools & Informational Content
Marketing Lead Tools are provided solely for general information and lead-generation purposes. They are not intended as legal, investment, or tax advice, and Casaztech makes no warranty as to their accuracy or suitability for any specific use.

3.5 Future Services
These TOS apply to any future Casaztech-branded or related service unless superseded by a specific agreement.

4. Client Obligations

  • Provide accurate information, documents, and timely approvals.

  • Maintain adequate property insurance at Client’s discretion and cost.

  • Comply with all Mexican housing, safety, and tax regulations.

  • Sign all necessary documents electronically within requested timeframes.

5. Payments & Billing

  1. Accepted methods: Credit/debit cards and other electronic payment solutions made available on Casaztech’s checkout pages or invoices. All transactions are processed by secure third-party payment processors.

  2. Currency: Charges may be presented in either U.S. dollars (USD) or Mexican pesos (MXN). The Client is responsible for any foreign-exchange differences or banking fees.

  3. Auto-billing: Subscription fees recur automatically on the billing cycle stated in the applicable Service Agreement. All fees are non-refundable unless otherwise expressly provided.

  4. Card-network disputes: Card payments remain subject to applicable card-network regulations regarding charge-backs. Nothing in these TOS limits a Client’s statutory rights under those rules, nor does it waive the dispute-resolution clause in Section 14 for matters beyond card-network scope.

6. Liability & Warranties

Services are provided “as-is.” Casaztech shall not be liable for indirect, special, or consequential damages and is liable only for its gross negligence or willful misconduct.

7. Force Majeure

Neither party is liable for delays resulting from hurricanes, power or internet outages, civil unrest, governmental actions, or other events beyond reasonable control.

8. Insurance Disclaimer

Casaztech does not provide property or liability insurance. Obtaining and maintaining any insurance coverage is the sole responsibility of the Client.

9. Tax Compliance

Client is solely responsible for all Mexican (and any other applicable) tax obligations arising from property income or other transactions.

10. Privacy & Data

Casaztech acts as data controller under Mexican privacy law. See the separate Privacy Notice for details on data collection, use, and retention.

11. Intellectual Property

All site content, reports, and software are the exclusive property of Casaztech or its licensors and may not be reproduced without written permission.

12. Amendments

Casaztech may update these TOS at any time by posting a revised version. Continued use of the website or services after the effective date constitutes acceptance. Material changes will be emailed 30 days in advance.

13. Electronic Signatures & Notices

Electronic signatures and records—including email, WhatsApp, or any recognised e-signature platform—constitute valid originals. Formal legal notices must be sent to [email protected].

14. Governing Law & Dispute Resolution

  1. Mediation: Parties shall first attempt mediation in the State of Quintana Roo within 30 days of written notice of a dispute.

  2. Jurisdiction: If unresolved, either party may commence proceedings in the competent courts of the State of Quintana Roo, Mexico.

  3. Card-network rules: Nothing herein limits Client’s statutory rights under applicable card-network regulations regarding charge-back timelines.

15. Severability

If any provision of these TOS is held invalid, the remaining provisions will remain in full force and effect.

16. Entire Agreement

These TOS, together with any applicable Service Agreement or SOW, constitute the entire agreement between Casaztech and Client, superseding all prior understandings.
